Brenda Cubbage brings over 30 years of experience to her commercial litigation and mediation practice. She has first and second chair jury and bench trial experience in state and federal courts, representing both plaintiffs and defendants in cases involving real estate, construction, liens, complex contracts, intellectual property, corporate and partnership issues, products liability, title insurance, deceptive trade practices and insurance/ reinsurance. Ms. Cubbage also has years of bankruptcy experience, including motion practice, adversary proceedings and litigation involving competing and contested plans. Many of Ms. Cubbage’s clients have been with her for more than 25 years.

Certified as an attorney–mediator in 1992, Ms. Cubbage specializes in both two party and large multi-party complex mediations. Ms. Cubbage has mediated over 1,600 cases in virtually all areas of the law, including real estate, construction, eminent domain, corporate and partnership issues, labor and employment, intellectual property, lender liability, deceptive trade practices, bankruptcy and insurance. Her experience as both a trial lawyer and a mediator has brought cost–effective and efficient resolution to difficult matters and informed the strategic decisions of her clients. She is considered by peers to be a tough, knowledgeable, impartial mediator who does not just "carry numbers back and forth."

A noted authority on lien laws in Texas, Ms. Cubbage co-authored a comprehensive reference book, "The Complete Guide to Mechanic's and Materialman's Lien Laws of Texas" from 1983 to 2006.

  • Obtained several significant court verdicts after jury and bench trials in Dallas and Houston for construction, real estate, title insurance, corporate and banking clients
  • Successfully litigated complex reinsurance disputes resulting in multi-million dollar recoveries for insurance clients
  • Defense of toxic tort asbestosis and attorney malpractice cases
  • Successfully litigated numerous adversary proceedings in bankruptcy courts

  • Successfully resolved over 1,200 cases involving a broad range of complex business issues for 2 to 20+ parties
